User Regulations

The User Regulations regulate the conditions under which the offer can be used.

Preamble

The Department of Electrical Engineering and Information Technology of TU Dortmund University operates an information processing infrastructure (IV structure) consisting of data processing systems (computers), communication systems (networks) and other auxiliary information processing equipment. These user rules regulate the conditions under which the service can be used. The user regulations

  • establishes the basic rules for proper operation of the IT infrastructure,
  • point out the rights of third parties to be respected (e.g. software licenses, requirements of network operators, data protection aspects),
  • obliges the user to behave correctly
  • informs about possible measures of the operator in case of violations of the usage regulations.

§ 1 Scope of application

  1. These user regulations apply to the IV infrastructure provided for Retina, consisting of data processing equipment (computers), communication systems, other auxiliary equipment for information processing and their premises.

§ 2 User group and tasks

  1. The IV resources mentioned in § 1 are available free of charge to members of the Department of Electrical Engineering and Information Technology of the TU Dortmund University for the fulfillment of their tasks in research, teaching, education and training, and public relations.
  2. Other persons may be permitted to use them.

§ 3 Admission procedure

  1. Admission can only be granted if future users fill out the corresponding registration form completely and truthfully and confirm the information with the help of a photo ID.
  2. The formal application (registration) for admission includes the following information: Surname, first name, matriculation number, start date of study, field of study, e-mail address and the declaration that the user accepts these user regulations. This personal data will be used for administrative purposes only and will not be disclosed to third parties in accordance with data protection laws.
  3. The Retina System Administrator decides on the application. He can make the granting of the user authorization dependent on the proof of certain knowledge about the use of the services or facilities.
  4. With the admission the user accepts these terms of use.
  5. The admission ends with the affiliation to the Department of Electrical Engineering and Information Technology of the TU Dortmund University.

§ 4 Rights and duties of the user

  1. The IV-resources according to §1 may only be used for the purposes mentioned in §2 (1). Use for other purposes, in particular for commercial purposes, is not permitted.
  2. The user is obligated to ensure that he/she uses the available resources responsibly. Violations may result in claims for damages.
  3. The user shall refrain from any kind of misuse of the IV infrastructure. In particular, he/she is obliged to
    1. The user is obliged to work exclusively with his/her user ID; the passing on of IDs and passwords is not permitted,
    2. The user bears full responsibility for all actions taken under his/her user ID, even if these actions are taken by third parties to whom he/she has negligently given access. The user is furthermore obliged:
    3. to observe the legal regulations such as copyright protection and copyright when using software, texts, images or other data.
    4. Not to repair malfunctions, damages and errors on the devices and the system by himself/herself, but to inform the administrator immediately. It is prohibited to interfere with the hardware installation or to change the configuration of the operating system or the network.
    5. to take care of the data backup by himself. Compensation for damages due to data loss is excluded.
    6. to use only the programs that have been installed on the Retina computers by the system administrators, exceptions will be announced on the Retina website.
  4. It is expressly pointed out that the following conduct in particular is punishable under the Criminal Code:
    1. spying out of data
    2. unauthorized alteration, deletion, suppression or rendering unusable of data
    3. computer sabotage and computer fraud
    4. the distribution of propaganda material of unconstitutional organizations or racist ideas
    5. the distribution of pornography
    6. retrieval and possession of documents containing child pornography The Department of Electrical Engineering and Information Technology of TU Dortmund University reserves the right to prosecute.

§ 5 Consequences of misuse or use contrary to the law

  1. In the event of violations of legal regulations or of the provisions of these usage regulations, in particular of § 4 (Duties of the user), the system operator may restrict or completely withdraw the user's authorization.
  2. Violations of legal regulations or of the provisions of these User Regulations will be investigated for their relevance under criminal law.

§ 6 Liability of the system operator/exclusion of liability

  1. The user is liable for any culpably caused damage to the facilities of the IT infrastructure and his/her workstations.
  2. The system operator does not guarantee that the system functions will meet the specific requirements of the user or that the system will run error-free and without interruption.
